LAS VEGAS (FOX5) — Prosecutors have decided the man accused of a deadly 12-car crash in the northwest valley will not face the death penalty, according to the District Court officials.

The collision occurred on Nov. 18 at Cheyenne Avenue and Jones Boulevard. There were three deaths reported following the crash, including the death of his girlfriend, Adilene Duran-Rincon, whom prosecutors say was pregnant at the time of the crash.

Jose Gutierrez, 19, is charged with three counts of open murder.

Prosecutors have maintained that the collision was intentional and had indicated they planned to seek capital punishment.

Nevada law allows the death penalty, but the state has not carried out an execution since 2006.

Gutierrez remains charged, and the case will continue through the court process. His jury trial is set to begin on May 18.
