LAS VEGAS (FOX5) -

The man accused of killing an 18-month-old girl is out from behind bars and getting ready to head home after he posted bail.

On Oct. 14, police officers arrested Demond Billingsley, 21, for the death of the little girl. Billingsley was babysitting Lyriq Clayton when she died. At a hearing, Billingsley's attorney said the death was an accident, but prosecutors said the girl was abused and was placed in scalding hot bath water.

"Essentially, he put this 2-year-old in bath water that was so hot, she had third-degree burns from her chin all the way to her feet," the prosecutor in the case said.

"When I got to the hospital, I saw her burned from the neck down," Lyriq's grandmother, Lisa Clayton, said. "She's gone and it was no accident."

Just two weeks after his arrest, Billingsley is getting ready to head home. The 21-year-old posted bail, and his lawyer told FOX5 he will be out of jail and on house arrest in the next few days.

The development in the case left the girl's family members stunned and angry.

"How do you get released on house arrest for first degree murder of this baby?" Lisa Clayton said through tears. "It's not fair at all. It's not fair."

Family members said now they aren't just looking for answers, they're looking for change.

"I'm doing everything in my power to reach out and find out what can I do," Lisa Clayton said. "What can we do? Because it's not fair, it's not fair."
