Law offers parents options for abandoned babies

GREENVILLE, SC (FOX Carolina) -

In the wake of the discovery of a newborn baby dumped in a Greenville trash can, authorities are reminding parents there are options for giving up babies.

Greenville police said they found a baby boy alive in a trash can along Chaney Street on Monday. The child's mother was later arrested and the infant was taken to the hospital in critical condition, police said.

Police said they want to remind the public of legal options for people needing to give up their newborns.

South Carolina is a safe haven state that offers parents the option to leave an infant that is up to 30 days old with an on-duty employee at any hospital, emergency medical services provider, law enforcement agency, fire station or any worship center.

According to Children's Trust of South Carolina, Daniel's Law offers protection to a person who abandons a newborn by leaving the child at one of those official locations. Any safe haven drop-off location must be staffed at the time the baby is left.

Daniel's Law states that if the baby has been harmed in some way, the immunity from prosecution may not apply. Also, the person leaving the child does not have to reveal his or her identity but they will be asked to provide medical information about the baby's parents, and if possible, the name of the baby's parents. This will help the medical personnel treat the baby for any health problems.

Children left at a safe haven will be placed into the custody of the South Carolina Department of Social Services, who will immediately pursue family court action to free the child for adoption
