Arias appears in court ahead of September retrial

PHOENIX (CBS5/AP) -

Jodi Arias, the woman convicted of murdering her ex-boyfriend in 2008, has returned to an Arizona courtroom as attorneys prepare for a second penalty phase.

Arias appeared in court Friday for a hearing that was closed to the media and public.

The second penalty phase was delayed in January when the lead prosecutor in the Arias case, Juan Martinez, revealed he had a conflict with another trial he is prosecuting.

Officer Anthony Holly was killed in the line of duty seven years ago. The trial for accused killer Brian Hulsey began Monday in what is the oldest capital murder case in Maricopa County and Martinez is the prosecutor in that case.

The judge in the Hulsey case said he would not delay Hulsey's trial any longer, so the judge in Arias' trial was forced to push back the retrial that was set for March 17.

The penalty phase retrial is set for September.

Arias, 33, was convicted May 8, 2013, of murdering her ex-boyfriend, Travis Alexander, in his Mesa home, but the jury could not reach an agreement on sentencing her to life in prison or giving her the death penalty.

Under Arizona law, while her murder conviction stands, prosecutors have the option of putting on a second penalty phase with a new jury. If they fail again to reach a unanimous decision, Arias would face life behind bars or be eligible for release after 25 years.

Judge Sherry Stephens has banned live television coverage of the retrial.
