ELOY, AZ (CBS5) -

An armed robbery suspect is facing charges, including first-degree murder, in the death of his accomplice during a shootout with Pinal County deputies.

The Pinal County Attorney Lando Voyles on Wednesday announced that charges have been filed against Adam Chavez, 23, of Queen Creek.

The probable cause statement accuses Chavez and Matthew Clowers of entering an adult boutique in Picacho Peak about 6:25 a.m., tying up the store's employee and taking the store's safe.

The employee was able to free herself and call 911, and a PCSO deputy saw the suspects' vehicle speeding and tried to stop it, according to Tim Gaffney of the Pinal County Sheriff's Office.

The suspects led a Pinal County sheriff's deputy on pursuit on state highway south of Coolidge on Dec. 23.

He said the suspects tried to ram the deputy's pickup truck. Both suspects got out of the SUV and fired at the deputy, who returned fire, said Sheriff Paul Babeu.

The deputy, who is a member of the Pinal County SWAT unit, hit both suspects, killing one immediately and wounding the other in their arm and leg. The shooting happened just before 7 a.m. on State Route 87, about three miles east of Eloy.

Chavez was taken to a local hospital where he was treated and later arrested.

Chavez faces one count of first-degree murder, one count of armed robbery, one count of kidnapping, one count of aggravated assault, one count of misconduct involving a weapon and one count unlawful flight from a law enforcement vehicle. He's being held on a $250,000 bond.

"Whether a suspect pulls the trigger or not, if committing any of the statutorily enumerated felonies and another individual dies as a result, that suspect potentially faces charges off first -degree murder," Voyles said.

The deputy, a seven-year veteran of the sheriff's office, was not injured.
