Police: Driver nearly 3 times legal limit in fatal DUI wreck

HENDERSON, NV (FOX5) -

A 24-year-old had a blood alcohol content three times the legal limit when he slammed his BMW into a wall in Henderson, killing his passenger, according to police.

Police said Arnold Cheung was the driver of a vehicle in a wreck that also killed 23-year-old Brian Jared Peters.

According to court documents, Cheung was charged with driving under the influence causing death, failure to obey stop sign at an intersection and speeding. Cheung was charged on Sept. 17, according to Clark County Courts.

The wreck happened in the early morning hours of Aug. 31 at the intersection of Pebble Road and Carnegie Drive, according to Henderson police.

Citing evidence and witnesses, police said Cheung's BMW was traveling at a high rate of speed eastbound on Pebble when it was approaching the T-intersection. The speed limit on that stretch is 35 mph, police said.

The vehicle struck a curb, causing the BMW to go airborne, hit two concrete posts and a wall of a flood channel. Police said crews were able to remove Cheung from the wreck and transport him to Sunrise Hospital.

Cheung's passenger, Peters, died at the scene but remained trapped in the vehicle, according to documents.

After getting a blood sample from Cheung at the hospital, police found he had a blood alcohol content of 0.224, which is nearly three times the legal limit of 0.08.

Friends of Cheung and Peters said the two were just leaving a bar bound for the latter's home.

A preliminary hearing for Cheung was scheduled for Nov. 20 in Henderson Justice Court.
