LAS VEGAS (FOX5) -

A Las Vegas middle school teacher charged with gross and open lewdness reportedly remains on the Clark County School District payroll.

A CCSD official told FOX5 Thursday that Alfphonso Washington's pay is based on a stipulation of teachers' contracts. The official, though, said five unexcused absences can lead to termination.

The absences could possibly happen if he is in jail five days or longer.

Las Vegas Metro police announced the 47-year-old Washington's arrest on Wednesday. Police said Metro's Sexual Assault detectives received information of lewdness allegations at the Lied Middle School campus in May.

Metro added on Thursday Washington was taken away from Lied when the allegations surfaced and was not reassigned.

Washington was a teacher and girls basketball coach for the school.

He is due to appear in Las Vegas Justice Court on Sept. 10.
