BRENTWOOD, TN (WSMV) -

The man accused of killing his wife at their home in Brentwood is now in a bitter legal fight with the woman's family.

Prosecutors say Randy Maidens killed Dr. Rachael Maidens at the exclusive Governors Club community back in April.

He's now out on bond, but Rachael Maidens' family wants to block him from using the couple's assets - including their home and a vehicle - to mount a legal defense. Her family says the couple's daughter, 2-year-old Natalie, should be the one who benefits.

Rachael Maiden's mother, Elizabeth Frisbie, has been caring for her granddaughter since the girl's mother died. She said the past several months have been expensive and emotional.

"Even though I was over at her house a lot, it's not the same without her mom there or her dad. She was very scared to be at my house," Frisbie said.

Randy Maidens was not present for Monday's hearing, during which the judge decided on several motions brought by both sides.

The judge ruled Randy Maidens can sell his vehicle, but he can only have 10 percent of the profit for now.

The judge also ruled the civil case will not happen until the criminal case concludes, and that could take up to two years.

One ruling in circuit court determined Randy Maidens could live in the Governor's Club home where he's suspected of shooting his wife, but a criminal court ruling already in place won't allow that to happen unless he agrees to constant GPS tracking, checking in and out with Brentwood police and having an attorney with him at the home at all times.

Officers testified Monday that Rachael Maidens was shot repeatedly with two different guns and was found in the foyer of the couple's home with 10 bullet wounds.

Investigators said they also found evidence that Randy Maidens, who has been charged with criminal homicide, attempted to clean up the scene.
