Man accused in fatal DUI wreck due in court

LAS VEGAS (FOX5) -

The man accused of driving under the influence when the car he was operating struck and killed four people at a west Las Vegas bus stop was slated in court for a pre-trial status check Friday.

Gary Lee Hosey pleaded not guilty four counts of driving under the influence causing death and six counts of DUI causing substantial injury.

According to Las Vegas Metro police, Hosey was the driver of an eastbound vehicle that lost control and slammed into a bus stop shelter at Spring Mountain Road near Decatur Boulevard on Sept. 13, 2012.

Police said Hosey was under the influence at the time of the accident, but attorneys for Hosey claim there is a discrepancy regarding how impaired he was at the time of the impact.

The arrest report shows an on-scene breathalyzer test found Hosey had a blood alcohol level above the legal limit of .08. According to the arrest report, Hosey claimed he had just one beer prior to getting in his car with four passengers on Sept. 13.

Blood tests showed Hosey also had marijuana in his system at the time of the accident.

During a pre-trial hearing in May, a judge granted a motion for an independent laboratory to retest blood samples regarding the DUI.

Hosey's hearing was scheduled for 9 a.m. Friday in Las Vegas Justice Court.
