PRESCOTT, AZ (CBS5) -

Prescott police have arrested a man they said had been squatting at a house previously owned by his parents for the last two years.

Richard E. Gray, 67, had to be taken by force after greeting officers with a holstered handgun at the bank-owned home, said Prescott police Lt. Ken Morley.

Gray's parents are deceased, the last one dying in 2010.

A Realtor representing the bank found the home broken into and called police when Gray refused to leave.

When officers approached Gray, he put his hand on the handgun he wore on his hip and refused to comply with their order to give up, Morley said. The Prescott SWAT team was then called in.

Negotiators talked with Gray over the phone for about two hours before he went outside and walked toward the SWAT officers and refused orders to stop, Morley said.

Officers fired rubber baton rounds at his lower body, forcing him to the ground where officers were able to take him into custody, Morley said, who added officers did not know whether he was still armed when he came out.

Morley said no payments had been made on the home since the last parent died, and that the locks had been changed but Gray broke back in. Morley said Gray was never listed as an owner of the home that he had "a free ride" for the last two years.

Gray was booked into the Yavapai County Jail in Camp Verde on a local warrant as well as charges related to the squatting, including trespassing. Morely said the final list of charges was being reviewed by Prescott police investigators and the Yavapai County Attorney's Office.
