Arizona school funding debate back in court

State officials are asking the Arizona Supreme Court to reverse a lower court ruling requiring the Arizona Legislature to provide public schools with an annual boost in funding to cover inflation.

Arizona Attorney General Thomas Horne says the Legislature shouldn't be beholden to a 2000 proposition approved by voters requiring annual inflation adjustments to school funding. Horne says voters don't have the constitutional authority to order the Legislature by statute to make the appropriation.

Proposition 301 required the Legislature to adjust school funding by about 2 percent per year to allow for inflation. The Legislature stopped funding it in 2010.

The state Court of Appeals ruled in January that any future school funding appropriations should include the inflation adjustment or run afoul of the state constitution's Voter Protection Act.
