Brooks expelled from NV Assembly in historic vote

CARSON CITY, NV (FOX5/AP) -

Steven Brooks was expelled from his elected seat in the Nevada Assembly on Thursday, marking the first time a legislator in the state was thrown out from the lawmaking body.

Majority Leader William Horne cited potential dangers and safety concerns in recommending expulsion during a brief address to the full Assembly.

The Assembly chamber was quiet and somber as the matter of expelling Brooks began with Horne delivering strong statements.

"Since the odd events that led to these proceedings, Assemblyman Brooks has continued to engage in questionable and unpredictable behavior. He has failed to acknowledge any responsibilities for the problems he has caused," he said.

Assemblywoman Dina Neal, who was the only committee member to vote against the expulsion recommendation, made an impassioned plea to consider a suspension instead.

"There are times as an elected official you have to stand on your own conscience and you have to find the courage to stand alone or the courage to stand with someone," she said.

The vote came by voice rather than roll call. Speaker Marilyn Kirkpatrick was visibly shaken and crying while calling for the vote.

Afterwards, Kirkpatrick, who was allegedly threatened by Brooks and has a protective order against him, was pensive.

"It's a very sad situation we're in. It's a very sad day for Nevada that we're having this discussion. For me personally, it's very hard to recognize that this is something that comes to an end right this moment. But I think we did what needed to be done," she said.

Brooks has threatened a lawsuit in the past, but Horne said he is confident the Assembly acted within its legal rights.

Brooks' job was on the line after a special committee recommended expulsion for the North Las Vegas assemblyman on Tuesday.

Brooks was suspended from the legislative building following two recent arrests. He faces charges for an alleged scuffle with officers after a domestic violence call at his wife's home.

Brooks also faces charges connected to threatening Kirkpatrick.

A two-thirds majority vote of the Assembly was required for the expulsion.

The Clark County Commission is now required to fill the vacancy left by the expulsion.
