LAS VEGAS (FOX5) -
A preliminary hearing was set May 7 for a Nevada lawmaker charged in a domestic incident and resultant scuffle with officers.
Charges in the alleged Feb. 10 incident were read in Las Vegas Justice Court Friday against Assemblyman Steven Brooks.
Brooks was arrested for a domestic incident involving his wife and the resulting scuffle with Las Vegas Metro police officers.
The D.A.'s office said Brooks was charged with a felony count of resisting a public officer with use of a firearm, a gross misdemeanor count of assault on an officer and counts of domestic violence battery and obstructing a police officer.
According to the D.A.'s office, the felony charge carries a maximum sentence of five years in prison and a $10,000 fine.
According to Las Vegas Metro police, officers responded to the home after Brooks' wife reported being assaulted by the assemblyman.
Brooks encountered arriving officers, according to an arrest report, and refused commands by police. One of the officers attempted to take Brooks into custody which resulted in a scuffle, police said.
"I got your gun!" Brooks was quoted as saying in the report during the alleged struggle with officers.
Police were able to control Brooks and take him into custody.
Brooks already faces charges for alleged threats at Assembly Speaker Marilyn Kirkpatrick. He was arrested in January for those charges.
Friday's hearing was scheduled for 8 a.m. in Las Vegas Justice Court. Brooks is not expected to appear, according to his attorney Mitchell Posin.
