LAS VEGAS (FOX5) -

The City of Las Vegas said embattled lawmaker Steven Brooks remains employed in the Parks and Recreation department but is on leave without pay during his legal issues.

City public information officer Diana Paul said, though, it is unclear how Brooks' case for threatening a public official will affect his job as a management analyst since he has not been convicted.

Meanwhile, Brooks' attorney Mitchell Posin said his client was released from hospital care for a mental evaluation. He was placed there last Friday.

The North Las Vegas assemblyman faces a charge connected to alleged threats he made toward Assembly Speaker Marilyn Kirkpatrick. Brooks was arrested on Jan. 19.

Since being released from custody, Brooks has exhibited questionable behavior in public.

Some of those instances include leaving the Nevada Legislative building in a hood, posing shirtless for a cover photo in the Las Vegas Review-Journal and a reported incident that took place at his grandmother's home.

His status for the start of the Legislative session, which begins Monday, also remains unclear.

Stay tuned to FOX5 for the latest on this developing story.
