Driver in fatal bus stop crash appears in court

Gary Lee Hosey, the man accused of drunken driving in the Thursday morning crash at a bus stop that killed four people, was denied bail during a 90-second court appearance Monday morning.

Defense lawyer Caitlyn McAmis asked Judge Conrad Hafen to release Hosey since the District Attorney's Office had yet to file formal charges.

"No, that's not going to happen," said Hafen.

District Attorney Steve Wolfson said he is waiting to file formal charges.

"We are waiting for some final reports to come in, specifically the toxicology reports, so we can learn what this young man's blood alcohol level was at and whether there were any illegal drugs or prescription drugs in his system," Wolfson said.

According to the arrest report, Hosey claimed he had just one beer prior to getting in his car with four passengers Thursday morning. He told police he lost control of the car when he hit a drainage dip in the intersection at Spring Mountain Road and Decatur Boulevard. Moments later, he lost control and the vehicle crashed into a bus shelter killing four people. 

The arrest report shows an on-scene breathalyzer test found Hosey had a blood alcohol level above the legal limit of .08. He also submitted to two blood tests while being treated for his injuries at Sunrise Hospital.

Hosey was driving without a valid license. "I expect multiple, multiple charges, perhaps felony DUI charges, perhaps feeling reckless driving charges," Wolfson said. "Based on what I know so far, I expect us to prosecute to the fullest extent of the law."

Outside the courtroom, a Hosey family spokesperson expressed the family's condolences to the families of the victims.

Hosey's next court appearance is scheduled for Friday at 7:30 a.m.
