A judge on Friday ruled that a dog that attacked and killed a 1-year-old boy can be euthanized, defying the small group of protesters who gathered outside the courthouse in defense of the animal.
District Court Judge Joanna Kishner lifted a temporary restraining order after hearing arguments from animal activists who hoped the dog, Onion, would be placed in a Colorado shelter.
After listening to arguments from both sides Kishner handed down her decision.
"Unfortunately, this court is going to have to cease the temporary restraining order. The courts (don't) determine the outcome of what happens to Onion. That's the city of Henderson's determination," she said.
Onion, a 6-year-old Mastiff-Rhodesian Ridgeback mix, was taken from his family after he mauled Jeremiah Eskew-Shahan during the boy's birthday party last month.
The boy's family believed the dog attacked when the child pulled on its fur in an attempt to stand up.
Supporters vowed to fight on despite the judge's ruling, and it was not immediately known when the dog would be put down.
Lawyers arguing on behalf of saving the dog said they will appeal.
"As soon as possible we're going to work diligently to try and reverse the decision," attorney Chandan Manensingh said.
