The dog who attacked and killed a 1-year-old boy has been saved from death, at least for now.
This comes after an animal rights group filed and received an injunction just hours before the dog was to be put to sleep.
Jeremiah Eskew-Shahan was killed late last month when his grandparent's Mastiff-Rhodesian Ridgeback mix bit him on the head and killed him.
The dog was scheduled to be killed Tuesday under Nevada state law.
But animal rights group The Lexus Project successfully won a temporary restraining order.
"The dog didn't do anything," said Richard Rosenthal, co-founder of The Lexus Project. "This was not a vicious attack where the dog attempted to tear the child apart, and it's not a situation where the child was on the ground and the dog went over to him and attacked him."
The group has set up for the dog to be sent to an animal sanctuary in Colorado, instead of being euthanized.
"They're willing to take the dog, evaluate the dog and rehabilitate the dog," Rosenthal said. "The dog can stay there as long as need be, including the rest of his life, if it turns out there is an aggression issue."
The judge's order allows both sides to negotiate a settlement by Friday morning. Otherwise, the issue will be heard in district court where Judge Joanna Kirshner will make a ruling.
Reaction from locals was mixed.
"I think they should take it and let the dog live until it's time for him to go," said Betsy Cordner. "I think it was just an accident. Did you see the pictures of the dog with the baby? It didn't look like he was going to hurt him. It just happened. It was just an accident."
"We support the Nevada SPCA, which is a non-kill shelter," said Jan Glaser. "But I feel there are always exceptions that have to be made, and if there's a vicious dog that has killed a baby, I think we have to value human life over a dog's life sometimes."
The child's father told FOX5 he wanted to make clear that his little boy was not left unsupervised and that the dog was not sleeping at the time.
