Couple Thinks They're Selling Home, Signs New Loan Papers

LAS VEGAS -- A Valley couple trying to sell their home say they were tricked into foreclosure by a member of their church.Florene and Darnese Horne said they wanted to sell their home, so they started distributing fliers at their local church. Soon after, they claim one of their church's deacon's daughter -- Melody Balize -- approached them, wanting to purchase the home."I feel very betrayed and I'm very hurt," Darnese Horne said. "She said 'I have someone interested in your house, pay cash right off the bat.'"In their lawsuit, the couple alleges Balize told them they needed to sign some paperwork to sell their home."I trusted her," Florene Horne said. "She's from my church."The couple met Balize at a title agency to sign more papers, they said. During the paperwork process, the Hornes said that Balize switched the paperwork without their knowledge. A few weeks later, the couple received a notice that they had actually taken out a loan for $86,000. They said they are now in debt because of the switch."I've been getting all kinds letters about foreclosures," Darnese Horne said. "It's nerve-wracking -- very nerve-wracking."The Hornes have asked Metro's Eldery Abuse Unit to investigate this case. They have filed suit against Balize, as well as Nations Title Co. and the other people involved in the transaction.FOX5 attempted to contact Balize, but she has apparently moved from her currently listed residence.A representative from Nations Title Co. said, "Our concern at this stage of the proceedings is to cooperate in every way possible and help the Hornes and their attorneys get to the bottom of what happened here."A judge has granted a temporary restraining order, preventing the Hornes' home from being foreclosed. The first hearing in this case is set for next week.
