VI. OFFENSE SYNOPSIS

Records of the Las Vegas Metropolitan Police Department and the Clark County District Attorney’s Office reflect that the instant offense occurred substantially as follows:

On November 22, 2005, officers of the Las Vegas Metropolitan Police Department responded to a Short Stop convenience store reference a robbery. It was reported two male adults entered the store and asked the clerk, if they could use the restroom.

The clerk “No.” They began to shop , the suspects tried to leave the store without paying for the items. The clerk told them they had to pay for the items. The co-defendant, lifted his shirt to display a black handgun. The clerk let the suspects leave and they ran and got into a silver 2000 Dodge Intrepid.

The driver, later identified as another co-defendant, was inside the vehicle with the engine running. They drove away northbound on Marion from Lake Mead. Officers located the suspects and activated their emergency equipment while traveling northbound on Lamb.

The driver accelerated away onto neighborhood streets. Officers pursued the vehicle which was traveling at speeds of approximately 40 to 60 miles per hour. The vehicle ran a stop sign and finally crashed. All three suspects fled on foot and all three were captured. A black plastic handgun was impounded. Inside the stolen vehicle, officers located the stolen items. All these items were returned to the store from where they were taken.

They stated one of the suspects sat in the car acting as the getaway driver with the engine running. Mr. Vazquez stated when confronted by the clerk, he turned around and showed her the gun to scare the clerk. Mr. Esparza stated he did not know one of the other suspects had a fake pistol. He also denied knowing the vehicle was stolen.. All three were arrested and transported to the Clark County Detention Center where they were booked accordingly.
